Everyone who has ever texted/talked on a non hands free cell phone knows your level of attention to driving goes down. It has to.
So while I agree with the basic logic of "just because a driver was on a cell phone doesn't mean the accident was automatically was caused by one"
talking, especially texting while driving is extremely dangerous and stupid.
