City Tells Woman She Can't Link; So She Sues
A woman named Jennifer Reisinger claims the Sheboygan, Wisconsin, city attorney ordered her to remove links to the city's police department web site from her personal site. She believes the order was motivated by her support of a previous recall of the mayor. She also claims the city launched a criminal investigation into her alleged web linking (which, of course, isn't illegal). Now, in a case that's historically unprecedented, she's SUING FOR A QUARTER-MILLION DOLLARS, plus unspecified damages.

This is a more interesting case. Linking is a form of advertisement but it's also a form of contact. It's legal to call someone, but if you call too often it's harassment. It's legal to email someone, yet spam (REAL spam, not just an email you didn't expect) is illegal. Linking is legal, but if it's done for the purpose of facilitating harassment should it be legal to force the linker to remove the link? Is there a difference between linking to a public website (such as a city department) and linking to someone's personal website (a personal blog or social networking profile)? If this goes high enough it could pose an interesting legal argument. Since the plaintiff may just be concerned that a Mexican is stealing an American job I doubt it will actually amount to much.
